Man indicted on sodomy charge

A Middlesboro man has been indicted for sodomy by the Bell County Grand Jury. Dustin Charles Green, 26, was indicted on the charge of first-degree sodomy for allegedly engaging in deviate sexual intercourse with a child under the age of 12.

According to the indictment, the alleged sodomy occurred in 2012. Officer Josh Pratt of the Middlesboro Police Department was the investigating officer in the case.

Green was also indicted for being a persistent felony offender.

Two people from Middlesboro were also indicted recently for their alleged involvement in the theft of a 1997 Jeep Wrangler. Charles Edward Woodby, 32, was charged with theft by unlawful taking over $500 and Donna Livesay, 40, was charged with complicity to commit theft over $500.

According to the indictment, Woodby allegedly took the Jeep from Quality Auto. The vehicle valued at approximately $5,900. Livesay allegedly aided Woodby in the theft by operating the vehicle.

Deputies Carl Frith and Mike Cooper of the Bell County Sheriff’s Department were the investigating officers in the case.

Woodby was also recently indicted on the charge of second-degree burglary.

A Pineville man was indicted on a theft-related charge involving an ATV. Matthew A. Warren was indicted on the charge of receiving stolen property over $500.

According to the indictment, Warren allegedly received, retained or disposed of a yellow Honda 350 Rancher while knowing the ATV was stolen. Cooper was the investigating officer in the case.

Other indictments recently handed down by the grand jury include:

* Dustin Glen Baker, 29, of Middlesboro, was charged with operating a motor vehicle while under the influence, driving on DUI suspended license, third-degree possession of a controlled substance, tampering with physical evidence and for being a persistent felony offender;

* John A. Winebrenner, 48, of Arjay, was charged with two counts of first-degree trafficking a controlled substance;

* Mitchell L. Hembree, 28, of Middlesboro, was indicted on the charge of fraudulent use of a credit card under $10,000 and second-degree forgery;

* Derek Steven Delk, 30, of Speedwell, Tenn., was charged with operating a motor vehicle under the influence, failure to wear a seat belt, use or possession of drug paraphernalia, tampering with physical evidence, first- and third-degree trafficking a controlled substance;

* Katherine M. Howard, 42, of Middlesboro, was charged with theft by deception over and under $500;

* Alicia J. Brock, 25, of Pineville, was charged with public intoxication of a controlled substance and first-degree possession of a controlled substance;

* Bruce Smith, 31, of Middlesboro, was charged with giving officers false name or address, resisting arrest, third-degree assault and for being a persistent felony offender.
